Terms of service

These terms are an agreement between you and PickVesting. By using PickVesting you accept them. If you do not, please do not use the service.
1. Read this part even if you skip the rest
- We are not an investment adviser or a broker-dealer. Nothing on PickVesting is personalized investment advice, and nothing here is a recommendation that any security is suitable for you.
- We never execute trades and never hold your assets. Brokerage connections are read-only. Your broker holds your money and is the only party who can act on your account.
- Verified past performance is still past performance. We work hard to make the numbers true. A true number about the past is not a prediction. You can lose money, including all of it.
- Every decision you make is yours. Creators publish what they did. What you do about it is your responsibility.
2. What the service is
PickVesting reconciles trades from a creator's linked brokerage account into positions, computes performance from those positions, and publishes the result. Creators may also publish written ideas, some of which are available only to paying subscribers. Readers may follow creators, subscribe, and discuss.
The published material is impersonal and is made available on a regular basis to everyone who subscribes on the same terms. It is not tailored to your situation, and we do not accept instructions to manage anyone's account.
3. Your account
You must be at least 18 and legally able to enter this agreement. Sign-in uses a one-time code sent to your email, so keeping your email account secure is what keeps your PickVesting account secure. Do not share access. Tell us promptly if you believe someone else is using your account.
One person, one account. Do not impersonate anyone, and do not register a handle designed to suggest an affiliation you do not have.
4. If you publish a record — the bargain
A verified record is only worth something because of what it costs to publish one. These conditions are not negotiable:
- The record covers the whole account. Every position in a linked account is included — stocks and options, every contract, including the ones that expired worthless. You cannot select which trades appear, and you cannot remove a losing one.
- Link every account you trade in that strategy. Publishing from one account while trading the same names in another that is not linked is a material misrepresentation, and grounds for removal.
- Disconnecting does not erase the record. Data stops flowing, the record is annotated to show when and for how long, and it stays published. Records do not get to end quietly.
- Every published idea must reference a real position you actually hold. Disclosure is produced by the system rather than typed into a box.
- The numbers are computed by us, using the definitions stated on the record page. You may dispute a computation and we will investigate; you may not substitute your own figures.
5. Publishing limits and monitoring
Some securities cannot be published about here. Before an idea is accepted we screen the symbol against minimum thresholds for market capitalisation, share float and trading volume. Names below those thresholds are refused, because an audience of any size can move a thinly traded stock. Where our data provider cannot answer one of those questions, we say so on the screening result rather than pretending the check ran.
After you publish about a position, a cooling-off period applies during which reducing that position is flagged for review. We also monitor incoming trade data for selling that follows publication. Flags are reviewed by a person, and any action taken is recorded and attributed.
You must not use PickVesting to manipulate a market. That includes accumulating a position in an illiquid name in order to promote it, coordinating publication with others to move a price, and publishing an idea you do not hold or do not believe. We will remove accounts for this and report conduct to the relevant authorities where appropriate.
6. Subscriptions and payments
Creators set their own prices. Subscriptions renew automatically at the stated interval until cancelled, and you may cancel at any time — access continues to the end of the period you have paid for. Payments are processed by Stripe; we do not see or store your card details.
Because subscriptions deliver access to content immediately, payments are generally non-refundable. We will refund where the law requires it, and we will consider refunds where a creator has stopped publishing or where a record turns out to have been misrepresented.
Creators are paid out through Stripe and must complete Stripe's identity and tax verification to receive funds. We may withhold a payout while a compliance flag on that account is under review. Creators are responsible for their own taxes.
7. Content and conduct
You keep ownership of what you write. You grant us a licence to host, display and distribute it on the service, including to your subscribers.
Do not post material that is unlawful, harassing, hateful, deceptive, or that infringes someone else's rights. Do not scrape the service, do not attempt to access content you have not paid for, and do not redistribute a creator's subscriber-only material. Anyone can report content from within the app or by writing to us, and we review reports and act on them.
8. Ending things
You may stop using the service and request deletion of your account at any time — see the privacy policy for exactly what is removed and what must remain.
We may suspend or terminate an account that breaches these terms. For serious matters — suspected manipulation, fraud, or risk to other users — we may act immediately. Otherwise we will tell you what the problem is and give you a chance to fix it.
9. Disclaimers and liability
The service is provided as-is. We do not warrant that it will be uninterrupted or error-free. We compute performance from data supplied by brokers and aggregators; while we reconcile that data carefully, we do not guarantee it is complete or free of error, and a record is only ever as good as the underlying feed.
To the fullest extent the law allows, we are not liable for trading losses, lost profits, or indirect or consequential damages arising from your use of the service. Nothing here excludes liability that cannot lawfully be excluded.
10. Changes and governing law
We may update these terms. The date at the top changes, and for material changes we will notify account holders by email before they take effect. Continuing to use the service after that means you accept the revised terms.
These terms are governed by the laws of the State of Delaware, United States.
